AI draft (not yet reviewed)

The Bill creates two bodies: the Kenya Universities and Colleges Central Placement Service, which places students and trainees in public tertiary institutions and runs career guidance, and the Tertiary Education Funding Authority, which raises money and gives education loans and scholarships. It sets up the Tertiary Education Fund to pay for the loans, says who can apply, and requires a loanee to start repaying within one year after finishing studies. Employers must deduct repayments from a loanee's pay and send them to the Authority within nine days after the month ends, and deductions are capped at 25% of the loanee's pay. An employer who is late in sending the money is charged 5% for each month or part of a month. The Bill repeals the Higher Education Loans Board Act and parts of the Universities Act and the Technical and Vocational Education and Training Act, and moves the property, liabilities and staff of the old boards to the two new bodies. It also changes the Limitation of Actions Act for civil cases to recover these loans.

Pia ina-set up Tertiary Education Fund ya ku-pay loans, ina-say who can apply, na loanee ana-start ku-repay loan within one year after ku-finish studies. Section 47 lets an eligible person apply to the Authority for an education loan for a minor (a person below the legal age of adulthood) who has been admitted to a tertiary institution. The loan is for the minor, and the application is made by the eligible person. This section does not itself say who counts as an eligible person.

Section 48 explains how a student or trainee asks for an education loan. Under subsection (1), once admitted to a tertiary institution (a college or university), a student or trainee who wants funding applies to the Authority in the way the rules set out. Under subsection (2), the Authority reviews the application and tells both the applicant and their tertiary institution its decision within a period the rules set out.

Section 49obligations of the loanee.

Matches youInakuhusuInakuhusuAI draft (not yet reviewed)

Section 49 sets out what a person with a student loan (a loanee) has to do. Repayment of the loan, with any interest and other charges that have built up, starts within one year after the person finishes studies. A loanee in formal employment tells the employer about the loan when the job starts, and a loanee in informal employment agrees a payment plan with the Authority on how and how often to pay. When the Authority deducts repayments from pay, it can take no more than 25% of the loanee's pay.

Section 49 ina-set obligations za loanee (person ambaye ame-take student loan).

Section 50Obligations of an employer.

Matches youInakuhusuInakuhusuAI draft (not yet reviewed)

This section sets out what an employer must do when an employee has a student loan from the Authority (a loanee). The employer tells the Authority in writing, or in another way the Authority specifies, when the loanee is employed. The employer deducts the monthly amounts set by the Authority from the loanee's pay until the loan is paid in full or the loanee leaves that job, whichever comes first, and sends them to the Authority within nine days after the end of each month. If an employer makes a deduction but does not send it in time, the Authority charges 5% of the total repayment amount for each month or part of a month it stays unpaid.

Section 50 ina-set obligations za employer wa loanee (person ambaye amechukua loan from the Authority). Employer ana-inform Authority in writing, ama kwa other way ambayo Authority ina-specify, loanee akianza job. Employer ana-deduct monthly amount ambayo Authority ina-decide kutoka pay ya loanee hadi loan iwe paid in full ama loanee a-leave hio job, whichever comes first, na ana-remit hizo deductions within nine days after end ya kila month. Employer akiwa ame-deduct lakini asi-remit on time, Authority ina-charge 5% ya total repayment kwa kila month ama part ya month ambayo repayment iko unpaid.

Section 51Debt recovery.

This section says that any money owed to the Authority counts as a debt that the Authority can collect. The Authority can recover it as an ordinary civil debt through a quick court process (called summary recovery). This is in addition to any other way the law already lets the Authority collect the money.

The repository must hold information on students funded by the Authority, repayment of loans, and placement of students.

Section 64 repeals three pieces of existing law. It removes the whole Higher Education Loans Board Act, Parts VII and VIII of the Universities Act, and Part IX of the Technical and Vocational Education and Training Act. To repeal means to take them out of the law, so they stop being law.

Section 65Transition. Cap. 210.

Matches youInakuhusuInakuhusuAI draft (not yet reviewed)

This section says which new bodies take over from old ones. The Kenya University and Colleges Central Placement Service succeeds the Kenya Universities and Colleges Central Placement Service Board, which was set up under section 55 of the Universities Act (repealed). The Tertiary Education Funding Authority succeeds three bodies: the Higher Education Loans Management Board (Higher Education Loans Board Act, repealed), the Universities Fund Board (section 53 of the Universities Act, repealed) and the Technical and Vocational Education and Training Funding Board (section 47 of the Technical and Vocational Education and Training Act, repealed).

Section 65 ina-name successors wa old bodies. Kenya University and Colleges Central Placement Service ina-take over kutoka Kenya Universities and Colleges Central Placement Service Board (section 55 ya Universities Act, repealed). Tertiary Education Funding Authority ina-take over kutoka three bodies: Higher Education Loans Management Board (Higher Education Loans Board Act, repealed), Universities Fund Board (section 53 ya Universities Act, repealed) na Technical and Vocational Education and Training Funding Board (section 47 ya Technical and Vocational Education and Training Act, repealed).

Section 66Transfer of property, assets and liabilities.

Matches youInakuhusuInakuhusuAI draft (not yet reviewed)

This section moves the property, assets, rights, obligations and debts (liabilities) of the former institutions to the Placement Service and the Authority, each taking over its own share, on the day the Act starts. Property and assets pass over automatically, with no separate transfer papers needed. Any agreement that names a former institution is read as naming the Placement Service or the Authority instead, unless the context requires otherwise. Court cases already under way for or against a former institution are treated as cases for or against the Service or the Authority.

Agreements zote ambazo zina-mention former institutions zita-be read kama zina-mention Placement Service na Authority, na court cases pending against former institutions zita-be against Service ama Authority.

66. (1) All references to the former institutions in any agreement or instrument relating to any property, assets, rights, obligations or liabilities transferred under subsections (2) and (3) and subsisting immediately before the commencement of this Act, shall at the commencement of this Act, unless the context otherwise requires be read as references to the Placement Service and the Authority respectively. (2) All movable and immovable property and assets which immediately before the commencement of this Act were vested in or possessed by the former institutions, shall, at the commencement of this Act, vest in the Service and the Authority respectively without further conveyance, transfer or assignment. (3) All rights, obligations, assets, liabilities which immediately before the commencement of this Act were vested in or imposed on the former institutions, shall, at the commencement of this Act, be deemed to be the rights, obligations, assets and liabilities of the Service and the Authority respectively. (4) All actions, suits or legal proceedings pending by or against the former institutions shall, at the commencement of this Act, be deemed to be actions, suits, or legal proceedings against the Service or the Authority.

Section 67Staff.

Matches youInakuhusuInakuhusuAI draft (not yet reviewed)

This section deals with staff of the former institutions. Anyone who was a member of staff of a former institution just before this Act starts is treated as a member of staff of the Service or the Authority, as the case may be. It is a transition rule: the staff become staff of the new bodies, and the section does not describe their pay or terms.

Section 68 explains what the words "former institutions" mean in this Part of the Bill. They mean four bodies: the Higher Education Loans Management Board (set up under the Higher Education Loans Boards Act), the Universities Fund Board, the Kenya Universities and Colleges Central Placement Service (set up under the Universities Act), and the Technical and Vocational Education and Training Funding Board (set up under the Technical and Vocational Education and Training Act). It is a definitions clause only and does not change anything else.

Ina-mean four bodies: Higher Education Loans Management Board (chini ya Higher Education Loans Boards Act), Universities Fund Board, Kenya Universities and Colleges Central Placement Service (chini ya Universities Act), na Technical and Vocational Education and Training Funding Board (chini ya Technical and Vocational Education and Training Act).
